Federal judge issues temporary restraining order allowing increased pumping from delta

February 5, 2010 -- Judge Oliver Wanger, Ninth District Circuit Court, put a temporary hold today on the BiOp for endangered salmon species -- a decision that should mean increased water pumping in the Sacramento-San Joaquin Delta.
Judge Oliver Wanger's decision only puts a two-week hold on that federal management plan, but it comes at a time when there is increased water flow into the Delta -- water that eventually makes its way to agricultural users in the Westlands Water District.
The basis for Wanger's ruling on Friday is the lack of endangered winter-run salmon around the Delta pumps.
If that situation changes, Wanger said the federal government could seek a change in the order.
Wanger's ruling is that the National Marine Fisheries Service management plan for salmon species did not consider its impact on humans.
