CSPA serves Notice Of Intent to sue if Sacramento Recycling does not clean up their operation

January 8, 2009 -- CSPA has served a 60-day notice letter of intent to sue (NOI) issued to Sacramento Recycling for violations of the federal Clean Water Act. 

The NOI alleges both procedural violations (inadequate stormwater pollution prevention plan, monitoring, reporting and BMP implementation) and violation of EPA benchmarks (benchmarks are the average discharge concentration of a properly operating business and are considerably above actual water quality criteria) for a number of pollutants; including, oil & grease, iron, aluminum, zinc, copper as well as salts and suspended solids. 

If settlement negotiations aren't proceeding satisfactory in 60 days (or if EPA or the waterboards don't initiate enforcement actions), CSPA will file a complaint in federal court.
