CSPA files Notice of Intent to Sue Castle and King Rock & Ready in Vacaville, is willing to meet to avoid necessity of court action

January 27, 2009 -- CSPA has sent Castle & King Rock & Ready a 60-day Notice of Intent to Sue for violations of the federal Clean Water Act. Castle & King, Inc. is a ready-mix concrete facility located in Vacaville California.

The notice letter alleges that the facility is illegally discharging polluted stormwater in violation of the substantive and procedural requirements of the General Industrial Stormwater Permit to the Vacaville stormwater system which discharges into Alamo Creek, Cache Slough, the Sacramento River and Delta.

The facility has discharged stormwater containing pollutants that exceed standards and failed to: 1) prepare an adequate Stormwater Pollution Prevention Plan, 2) implement an adequate monitoring and reporting program and 3) install management measures to reduce or prevent pollutants from entering waterways. Discharged pollutants include extremely high levels of total suspended solids, specific conductivity and pH. The facility failed to monitor for numerous constituents that are generally present at concrete manufacturing operations including iron, aluminum, arsenic, chemical oxygen demand, chromium, copper, manganese, nickel, nitrate/nitrite and zinc. ...(Continued)

Pursuant to the citizen-suit provisions of the federal Clean Water Act, CSPA is required to send a potential defendant a notice letter informing them of the specific violations that have been identified. The USEPA, US Department of Justice, state Attorney General and the Regional Water Quality Board are copied and, if the agencies fail to initiate enforcement actions within 60 days, CSPA is free to file a lawsuit against the discharger. CSPA has offered to meet with Castle and King to see if the matter can be resolved before the lawsuit is filed.
